The Department of Law/Office of the Attorney General, Consumer Protection Section is seeking a talented and enthusiastic attorney with significant experience in state and federal court civil litigation to join our Medicaid Fraud Control Unit. This position offers an exciting opportunity to serve as a lead litigator and mentor, focusing on investigating and litigating civil violations of Medicaid False Claims Acts at the state and federal levels, and multi-state investigations and litigation of qui tam cases against national providers. WHAT YOU WILL DO

The Colorado Medicaid Fraud Control Unit (COMFCU) is a federally mandated and funded civil and criminal investigative, prosecutorial, and litigation unit consisting of six attorneys, thirteen sworn investigators, a forensic auditor, a paralegal, a nurse analyst, and a program assistant. The mission of the unit is to investigate, criminally prosecute, and civilly litigate (1) fraud by healthcare providers, healthcare facilities, pharmaceutical manufacturers, pharmacies and other providers that illegally divert Medicaid funds, and (2) abuse or neglect in Medicaid funded facilities or among Medicaid recipients.

The dual missions of the COMFCU are:

  • To protect the state and federal funds dedicated to providing healthcare and medical services to Colorado Medicaid beneficiaries.

  • To hold individuals accountable for the abuse, neglect, or financial exploitation of clients in board and care facilities as well as those in facilities that accept Medicaid dollars.

The Colorado Medicaid Fraud Control Unit (COMFCU) maintains a strong commitment to ensuring that Coloradans have access to the highest quality of care from dedicated providers while continuing to take an aggressive approach to reducing Medicaid fraud and patient abuse across the state.

In this role as Senior Assistant Attorney General – Civil Litigation Specialist, you will have the opportunity to:

  • Supervise and litigate complex civil cases involving violations of the state Medicaid False Claims Act (MFCA) and federal False Claims Acts (FCA) at all phases of litigation, including investigation, evaluation, discovery, motions practice, trial, appeal, and settlement.

  • Manage a wide variety of nationwide and local qui tam litigations to promote Colorado’s efficient and impactful participation in civil Medicaid fraud litigation throughout the United States.

  • Contribute to multi-state investigations and litigation of qui tam cases against national providers, including filing Medicaid False Claims actions against providers.

  • Lead litigation teams comprised of attorneys, investigators, investigative auditors, data analysts, investigative nurse analysts, and paralegals at all stages of investigations and litigation, while providing mentoring, coaching, and professional growth opportunities to other lawyers and professional staff.

  • Collaborate with multi-disciplinary teams and provide advice to the U.S. Attorney’s Office, U.S. Department of Justice, the Office of the Inspector General, and other federal partners on joint investigations.

  • Communicate with victims and other stakeholders to keep them apprised of the status of COMFCU investigations and cases as well as to prepare them for testimony.

  • Develop and/or deliver training on Medicaid False Claims Act litigation and on developments in state and federal Medicaid Fraud law.

  • Research federal and state laws and regulations governing both the general provision of healthcare as well as the specific governance of the administration of the Colorado Medicaid program and suggest revisions to the same based upon gaps and deficiencies that may be discovered during case work.

  • Travel throughout Colorado, for investigations, court appearances, hearings, and trials and to conduct training and public outreach.

Salary Note: The Department of Law uses a wage progression compensation model. Although a salary range is listed, salary will be set commensurate with the successful candidate’s qualifications and in compliance with the Equal Pay for Equal Work Act.

In order to be appointed as a Senior Assistant Attorney General, candidates must have a minimum of five years experience as civil litigation attorney in state/federal courts. If the position is filled at the level of Senior Assistant Attorney General, the pay range will be $106,309 to $140,000/year.

If the position isn’t filled as a Senior Assistant Attorney General, the pay range will be at that of Assistant Attorney General II, which is $94,426 to $120,000/year.

WHAT WE ARE LOOKING FOR

Applicants must be admitted to the Colorado bar or be clearly eligible to waive into the Colorado Bar and be in good standing at the time of application. Candidates eligible to waive into the Colorado Bar will be required to submit proof of their completed application and application for Practice Pending Admission before the first day of employment. For this Senior Specialist attorney position, we are seeking applicants who have aminimum of five years of demonstrated experience with civil litigation in state and/or federal courts.Experience in the government sector and/or qui tam litigation is needed for this position, other similar types of federal complex litigation experience may be considered.

Applicants should highlight in their cover letter any civil litigation experience, including any experience with multistate litigation teams. Applicants are also encouraged to describe their experience mentoring lawyers and staff and providing outreach on legal issues.

We are looking for a teammate who has excellent interpersonal and client relationship skills, who thrives in and enjoys fostering a collaborative and friendly work environment but who can also effectively work independently. The strongest candidates will also have:

  • More than the minimum of five years of civil litigation experience in state and/or federal court.

  • Knowledge of and experience with healthcare fraud, the healthcare industry, the Colorado Medicaid Program, or FCA litigation (state or federal) is helpful.

  • Excellent time management skills and the ability to handle a large portfolio of cases and advice work with minimal supervision.

  • Strong organizational skills with a demonstrated ability to manage multiple cases in various stages of litigation.

  • Strong litigation, analytical, research, and oral and written communication skills.

  • Strong negotiation skills.

  • Excellent interpersonal and client relationship skills.

  • Experiencing mentoring others or leading trial teams in complex federal litigation.

  • A demonstrated ability to work collaboratively.

  • Maturity and judgment when dealing with high-level stakeholders, including knowing when to consult teammates and supervisors.

  • The ability to be a self-starter who is capable of and enjoys working independently.

  • A demonstrated commitment to diversity, equity, inclusion, and public service.

The ideal candidate for this position should be comfortable overseeing assigned cases from intake through settlement or trial. Ideal candidates will be highly self-motivated, be creative in thinking about litigation, and be willing to aggressively litigate healthcare fraud cases. Candidates should demonstrate familiarity with document-intensive civil or criminal investigations and complex litigation generally. A successful candidate would be assigned their own caseload but would lead and mentor a team of attorneys, investigators, investigative auditors, and paralegals and would interact with their team regularly.

CONDITIONS OF EMPLOYMENT

  • Applicants must pass a thorough background investigation prior to appointment.

  • The Medicaid Fraud Control Unit functions on a hybrid work model. Employees are expected to work in-office for the first 90 days. After the first 90 days, employees are expected to work in-office at least 2 days a week, subject to supervisor approval. Applicants should therefore be within commuting distance from the office. Additional flexibility may be considered for employees who have demonstrated their contribution and commitment to the team.

  • State-wide travel is expected, including trips which may require long distance driving. A valid drivers license is required.
